General Terms and Conditions

1. Scope of Application
These General Terms and Conditions (“GTC”) govern the contractual relationship between the sole proprietorship Carmo Piller Kreativbüro (hereinafter “EdiArtInfo”), based in Herisau, Switzerland, and its customers.
They apply to all contractual relationships concluded via the website www.ediartinfo.ch or directly between EdiArtInfo and its customers.

For physical goods (including artworks, prints, and other tangible products), the offer is directed exclusively to customers with a delivery address in Switzerland.
For services, workshops, coaching, online courses, or other digital content, EdiArtInfo may enter into contracts with customers residing in Switzerland, Europe, or South America (including Brazil).

EdiArtInfo reserves the right to amend these GTC at any time. The version in force at the time the contract is concluded shall apply.

2. Availability of the GTC
The current version of the GTC is always available for viewing, printing, or download at www.ediartinfo.ch.

4. Registration and Communication
Customers may provide their contact details (email, phone number, address) for orders, inquiries, or business communications.
EdiArtInfo may send occasional emails with news or promotions. Customers can unsubscribe at any time.

5. Orders and Conclusion of Contract
5.1 Order process

  • Selection of desired products or services

  • Completion and submission of the contact form

  • Receipt of confirmation email with invoice and additional details

  • Payment by the customer

  • Delivery or provision of the service according to agreed deadlines

5.2 Conclusion of contract
The presentation of goods and services does not constitute a binding offer but an invitation to order.
The contract is concluded only after explicit confirmation by EdiArtInfo via email.
EdiArtInfo reserves the right to reject orders without providing reasons.

6. Prices and Payment
All prices are in Swiss francs (CHF).
EdiArtInfo is not subject to VAT.
Payments may be made via PayPal, Twint, or bank transfer.

7. Delivery of Physical Goods
Delivery only within Switzerland, free of shipping charges for the customer.
Delivery time: 5–7 working days after payment receipt (subject to availability).
Risk and responsibility transfer to the customer upon handover to Swiss Post.
Ownership of the goods remains with EdiArtInfo until full payment is made.

8. Services and Events
Workshops, coaching, and online services can be booked internationally.
Execution takes place according to the dates specified in the confirmation.
If EdiArtInfo cancels the event, customers receive either a rescheduled date or a refund.

9. Right of Withdrawal (Returns)
Physical goods:
Customers may withdraw within 14 days of receiving the goods.
The product must be returned within 7 days of the withdrawal notice, unused, undamaged, complete, and in its original packaging.
Return costs and risk are borne by the customer, except in the case of defective goods, in which case EdiArtInfo bears the return costs.
Refunds are processed only after receipt and inspection of the returned goods.

Digital products and services:
No right of withdrawal after sending the confirmation email, unless expressly agreed otherwise.

10. Warranty and Quality
EdiArtInfo mainly sells unique items. Variations in color or brightness between the original and the displayed image do not constitute a defect.
Defects must be reported in writing within 7 days.
Statutory warranty rights for hidden defects remain unaffected.

11. Copyright
All content, works, images, and designs on www.ediartinfo.ch are protected by copyright and trademark laws. Any use without prior written consent is prohibited.

12. Data Protection and Data Security
The Privacy Policy is part of these GTC and is available on the website.
Data is treated confidentially and used only for contract execution.
While SSL encryption is used, EdiArtInfo cannot guarantee complete security of data transmission over the internet.

13. Image Rights at Events
By participating in events, customers consent to the use of images or videos for promotional and documentation purposes, provided they are not depicted in a derogatory manner.
Withdrawal of consent is possible at any time but applies only to future publications; already published content will be removed where technically and economically feasible.

14. Limitation of Liability
EdiArtInfo is liable only for damages caused by intentional or grossly negligent behavior.
No liability for indirect or consequential damages.
The use of content for therapeutic, medical, or psychological purposes is solely the customer’s responsibility.
EdiArtInfo accepts no liability for direct or indirect damages resulting from such use, including by third parties.

15. Third-Party Providers
EdiArtInfo may delegate services in whole or in part to qualified third parties.

16. Severability Clause
If any provision of these GTC is invalid, the remaining provisions shall remain in effect.

17. Applicable Law and Jurisdiction
Exclusively Swiss law applies, excluding the Vienna Convention (CISG).
For business customers, the place of jurisdiction is Herisau, Switzerland. For consumers, mandatory consumer protection laws apply.
For international customers, Swiss law applies exclusively, with jurisdiction in Herisau.
